I was hangin out in front of my friend's house last night cause they were having a party, like just about every other house on a thursday night on Ohio State's Campus, but I wasn't drinking cause I had to go pick up my g/f. Well I'm getting ready to leave and go to my car parked out front and get in. I turn on my music and leave, and my buddy calls so I turn it off and talk to him. Next thing I know a bicycle cop is in the middle of the road signaling to pull over..like 50 feet down the road from my friend's house. He comes up and says "I could hear your music down the road after you pulled out down there. There is a 50 ft noise ordiance." Mind you, every house in the vicinity is blaring music and drinking. He takes my license and leaves for like 5 minutes leaving a woman to sit and watch. He comes back and asks if my muffler is aftermarket. I say yes, I wasn't aware that was illegal. He said anything that is not stock sounding is illegal in columbus, and "a cavalier isn't supposed to be loud at all."
So he tickets me, no warning for $220 for an aftermarket muffler, and a "loud sound amp." I'm not happy :-( Anyone who has heard my exhaust on here can attest that it isn't loud at all. I think he was just bored..

You should ask in court for a DB reading that he SHOULD of done at the back of your car.. That wont stand up in court from him saying that it 'sounds's too loud.. F that man.. Thats just like if a cop stops you for speeding, all you have to do is say show me the read out on the gun.. If he doesnt, then he cant prove it was you.. Adam got out of a ticket that way..
And F him for the cavalier not supposed to sound like that comment.

Maybe some localized rules, and you'd have to find the statutes for sure, but this should give you a place to start. The only noise part there pertains to motorcycles and mopeds.
I found the digest of laws (http://www.bmv.ohio.gov/pdf_forms/HSY-7607.pdf) and under vehicle equipment regulations, it is nice and vague. Bring it up with the judge if you want, but if it's any louder than stock at all they can most likely get you for it if the cop is in the mood to. The description primarily deals with not polluting any worse, but sounding "Unusual" and "Excessive" noise. Cop probably had a burr up his ass.
The stereo noise might be a localized ordinance. Again, the cop must have had a burr up his ass, and was hoping perhaps for a DUI bust.

Yeah, I'm pretty pissed..will the DB level hold up in court? Because I'm def. willing to try that, and David..I dunno if you heard my car at the Cobalt meet..but it's just not very loud at all..I'm kinda stumped..I'm pretty sure he was jsut trying to get me for DUI bust cause he saw me leave my friend's house where they were drinking, and got pissed cause I didn't drink at all and got me for anything he could..even worse, it was an F'ing bike cop..wtf.
I also got a ticket for having solid..non flashing white neons under my car last year..they are sucks pricks around here..

The thing is the cop doesn't have to show you the radar reading at all,and what sucks is that most that most judges will take the officers word over yours.My friend tried to have the officer show the court that his radar was calibrated correctly and he still lost.

I know but they didn't take a reading at all..it would be one thing if they did and didn't have it at court..but they never did it..my friend who is in the police academy is telling me to fight it..and as far as the system goes..I can't do @!#$ about that..it's my word against his..even though I didn't have it turned up after I left

I didnt think they can give you a ticket without showing how loud it was. I mean, they couldnt bust you for drunk driving if they didnt have a BAC level. I'd definately try fighting that one. What good it will do you, who knows. But pleading not guilty and losing the case does not increase your fine or your punishment. Court cousts are already figured into that fine.... actually, by going to court and losing on a seatbelt ticket, I paid less for the ticket than a number of people at work. The judge will tell you how it costed you more or whatever, but if it's an 80 dollar ticket, it could be something like in reality only a 40 dollar fine, they just tack on 40 bucks of court cost.

There's ways to go about that. And a subpeona to the police department for all the calibration and maintenance records for the radar unit, would be the correct way.

man that definitely sucks. I think alot of this will depend if have had trouble in the past. and if you havent I dont think much will stand. Here in the Louisville KY area, "most" of the police are pretty cool as far as not pulling over people for neons and loud exhaust. I guess that guy was having a bad night. Hope it goes well for ya.

that is some bs. and I am pretty sure I just saw you on 70/670/315 coming back towards campus. if that was you, your exhaust isn't too loud. I could hear it on the highway, but there's 4 cars on my street alone that are easily louder

I just talked to my roommate who's dad is a lawyer and he said I'd be able to fight it due to the area, and my previous recod being pretty clean, 1 speeding ticket and then the ticket for neons. He said the exhaust thing won't hold up in court well with a reading and the stereo thing is more of discretion, but I should eb able to fight it, due to the fact it was during "quiet hours" and the fact it was on a college campus..Thanks for the support..I was kind of expecting to get the you got a ticket don't be a bitch and pay it reponse..court is a week from today..I'll keep everyone updated.

Alright..had court yesterday..I went in a complained that they shuold have had a decibel reading from the exhuast..prosecutor agreed...muffler violation got thrown out easily..complained about the noise violation, he said it's my word agaisnt his, so he can't drop it, but he knocked it down to $40, so with court costs I paid $115..I guess it's better than $210..but shouldn't have to pay anything
..oh well
